OVERVIEW
Welcome to Luce Spaces. The terms “Luce Spaces,” “we,” “us,” and “our” refer to Luce Spaces LLC.
Luce Spaces operates this website and online store, including the related information, content, features, tools, products, and services made available through it (collectively, the “Services”).
Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services to you. Purchases made through the Services are transactions directly between you and Luce Spaces LLC.
These Terms of Service, together with our Privacy Policy, Shipping & Delivery Policy, Refund & Return Policy, and any order-specific quotation, invoice, drawing, specification, or written agreement, describe the terms that apply when you access or use the Services or purchase products from us.
Please read these Terms carefully. They contain important information regarding orders, custom products, natural stone variation, delivery, returns, limitations of liability, and dispute resolution.
By accessing or using the Services or submitting an order, you agree to these Terms. If you do not agree, you should not use the Services.
SECTION 1 — ELIGIBILITY, ACCESS, AND ACCOUNTS
By using the Services, you represent that you are legally able to enter into a binding agreement or that you are using the Services with the permission and supervision required under applicable law.
You may be asked to provide information including your name, email address, telephone number, billing information, payment information, and delivery address.
You represent that information supplied by you is accurate, complete, and current and that you are authorized to provide and use it.
You are responsible for maintaining the confidentiality of any account credentials and for activity conducted through your account.
You may not transfer, sell, assign, or license your account to another person without our written permission.
SECTION 2 — PRODUCTS AND PRODUCT AVAILABILITY
We make reasonable efforts to describe our products accurately. Product descriptions, specifications, availability, pricing, finishes, dimensions, weights, production schedules, and other information may be updated without prior notice.
Products may be:
- ready to ship or available from existing inventory;
- prepared or produced after an order is placed;
- made to order; or
- customized according to customer-approved specifications.
Product availability shown through the Services does not constitute guaranteed inventory or guaranteed acceptance of an order.
We may discontinue products, materials, finishes, options, or services at any time.
SECTION 3 — NATURAL STONE CHARACTERISTICS AND VARIATION
Natural stone is formed by nature, and every piece is inherently unique.
Variations in color, tone, veining, pattern, texture, mineral markings, pores, pits, fissures, surface movement, and other naturally occurring characteristics are normal features of natural stone.
No two natural stone products should be expected to match one another exactly.
Natural variations are not considered defects by themselves.
Product photographs, samples, renders, and displays are intended to represent the general color range, texture, finish, design, and character of the material. The delivered product should not be expected to match website photographs, renders, samples, or another stone piece exactly in color tone, pattern, or veining.
Lighting, photography, screen settings, sealing, finishing, and the natural composition of the stone may affect its appearance.
This section does not apply to verified structural damage, transit damage, an incorrect product, a material manufacturing defect, or a product that materially fails to conform to customer-approved written specifications.
SECTION 4 — PRODUCT IMAGES, RENDERS, AND INCLUDED ITEMS
Product photographs, renders, room scenes, samples, and visual materials may include items used for styling or context.
Only products, components, accessories, and services expressly identified in the applicable product description, quotation, invoice, order confirmation, or written agreement are included in the purchase.
Faucets, drains, cabinetry, mirrors, lighting, décor, mounting hardware, installation materials, and other items shown in photographs or renders are not included unless expressly stated.
Faucet holes, drain holes, mounting holes, overflow openings, cutouts, and other product modifications vary by product and order.
No opening, cutout, drilling, or modification should be assumed unless it appears in the product-specific information or is confirmed in writing by Luce Spaces.
SECTION 5 — DIMENSIONS, WEIGHTS, AND SPECIFICATIONS
Product dimensions, weights, capacities, and other website specifications are approximate unless expressly confirmed in writing for a specific order.
Minor variations may occur because of natural material characteristics, hand finishing, and production methods.
Customers and installers should verify the delivered product’s actual dimensions and weight before preparing cabinetry, countertops, plumbing, support structures, mounting locations, or installation openings.
If preparations are completed using website dimensions alone and additional work becomes necessary, the circumstances will be reviewed on a case-by-case basis.
Verified manufacturing errors or material deviations from customer-approved custom specifications will be evaluated separately.
SECTION 6 — CUSTOMER-PROVIDED INFORMATION
Customers are responsible for the accuracy and completeness of measurements, drawings, templates, dimensions, specifications, photographs, delivery information, and other technical information they provide.
Luce Spaces is not responsible for fitment problems, production issues, delays, installation expenses, or other consequences caused by inaccurate, incomplete, or misleading customer-provided information.
Customers should review all drawings, measurements, finishes, openings, quantities, and order details carefully before providing approval.
If Luce Spaces expressly modifies or replaces customer-provided information in writing, the most recent written confirmation will govern.
SECTION 7 — CUSTOM SPECIFICATIONS AND CUSTOMER APPROVAL
Custom dimensions, materials, finishes, colors, openings, drawings, and other order-specific specifications may require written customer approval before production.
Once the customer approves custom specifications in writing, production may proceed based on that approval.
Requests arising from a later change of mind, an incorrect customer-provided measurement, or a specification previously approved by the customer will be reviewed on a case-by-case basis.
Cancellation, remake, replacement, refund, or another resolution is not guaranteed in such circumstances.
If Luce Spaces verifies that a product materially differs from the customer-approved specifications due to an error by Luce Spaces, an appropriate resolution will be provided subject to these Terms and applicable law.
SECTION 8 — PRE-SHIPMENT PHOTOGRAPH APPROVAL
For many natural stone and custom orders, Luce Spaces may provide photographs of the actual product or selected stone before shipment.
This process is available for many orders but is not guaranteed for every product or order unless confirmed in writing.
When photographs are provided for approval, the customer is responsible for reviewing visible color, tone, veining, pattern, finish, and other natural characteristics shown in the images.
After approval, Luce Spaces may proceed with shipment and provide tracking information.
Photograph approval confirms acceptance of the visible natural appearance shown at that time. It does not waive valid claims involving transit damage, structural defects, an incorrect product, or a material failure to match approved written specifications.
If the customer does not respond to an approval request, Luce Spaces may send one or more reminders.
The order will remain on hold until the requested approval is received. Silence will not be treated as approval.
Customer-caused approval delays may extend estimated production and delivery timelines.
SECTION 9 — SAMPLES
Samples represent the general color range, texture, finish, and character of the selected natural stone.
Because natural stone is unique, the final product will not be identical to a sample in color tone, veining, pattern, mineral markings, or other natural characteristics.
A difference between a sample and the final product is not, by itself, considered a defect.
Sample fees are separate from the final product price unless Luce Spaces expressly offers a credit through a promotion, quotation, invoice, or written confirmation.
Sample shipping charges may vary by destination, sample type, promotion, or applicable written offer.
Sample return and refund requests are reviewed on a case-by-case basis. Approval of a refund, replacement, credit, return, or other resolution is not guaranteed.
Unauthorized sample returns will not be accepted.
SECTION 10 — ORDERS AND ACCEPTANCE
Submitting an order constitutes an offer to purchase.
An automated order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance.
Luce Spaces may review product availability, specifications, payment, delivery requirements, fraud risk, and other order details before accepting or fulfilling an order.
An order is accepted when Luce Spaces confirms acceptance or begins fulfillment, production, or shipment, as applicable.
We may reject, place on hold, or cancel an order for a reasonable business or legal reason, including suspected fraud, unauthorized payment, materially inaccurate information, prohibited activity, product unavailability, pricing errors, or significant transaction risk.
If an order is canceled after payment has been captured, the amount collected for the canceled order will be refunded to the original payment method.
SECTION 11 — ORDER CHANGES
Customers are responsible for reviewing product selections, dimensions, finishes, quantities, shipping information, and other order details before submitting an order.
When a correction is requested before production or shipment begins, Luce Spaces will make reasonable efforts to accommodate it when feasible.
Any price difference, additional material or labor expense, rework cost, carrier fee, address-correction charge, or other cost caused by the requested change may be charged to the customer.
A requested change is not effective until confirmed in writing by Luce Spaces.
SECTION 12 — PRICES, PAYMENT, TAXES, AND IMPORT COSTS
Prices, discounts, promotions, and product availability may change without notice.
The price charged will generally be the price confirmed for the applicable order, subject to correction of material errors.
Applicable sales taxes and separately selected services may be added at checkout or through an order-specific quotation.
For qualifying orders delivered to customers in the United States, applicable customs duties and import charges are covered by Luce Spaces and included in the order total unless a different arrangement is expressly disclosed and agreed in writing before purchase.
Customers should not be charged an undisclosed additional customs or import duty beyond the confirmed order total for such orders.
Customers agree to provide accurate and current billing, payment, and account information.
SECTION 13 — PRICING, INVENTORY, AND SYSTEM ERRORS
Luce Spaces may correct material errors involving pricing, inventory, product information, promotions, shipping terms, availability, or system-generated order details.
If a material error is discovered after an order has been placed or paid, Luce Spaces may:
- contact the customer and offer corrected terms; or
- cancel the affected order and issue a full refund.
No additional amount will be charged without prior notice and agreement.
SECTION 14 — READY-TO-SHIP CANCELLATIONS
Standard ready-to-ship products may be canceled for a full refund before the order has shipped.
Once the order has been transferred to the carrier, it can no longer be canceled and will instead be subject to the applicable return policy.
SECTION 15 — MADE-TO-ORDER CANCELLATIONS
When production or preparation of a made-to-order product has begun, cancellation requests will be reviewed on a case-by-case basis.
Cancellation approval and a full refund are not guaranteed after production has started.
Material, labor, production, design, and other costs already incurred may be considered when reviewing the request.
SECTION 16 — CUSTOM ORDER CANCELLATIONS
Once customer-approved specifications have been confirmed and production of a custom product has begun, cancellation and refund requests will be reviewed on a case-by-case basis.
Approval of a cancellation, refund, credit, remake, or other resolution is not guaranteed.
Costs already incurred for design, materials, labor, production, or other order-specific work may be considered.
SECTION 17 — SHIPPING AND DELIVERY
Shipping and delivery are governed by our Shipping & Delivery Policy, which is incorporated into these Terms.
Standard freight delivery generally means curbside or driveway delivery at an accessible location determined by the carrier.
Standard delivery does not include carrying a product inside, room placement, unpacking, installation, stair carry, assembly, or removal of crates and packaging.
Additional services may be available when agreed in writing and may involve additional charges.
Standard freight delivery generally includes liftgate service so the carrier can lower the crate to the designated curbside or driveway delivery point.
For unusually heavy products, restricted locations, or shipments for which liftgate service is unsuitable or unavailable, unloading requirements may vary. A forklift, unloading equipment, or additional personnel may be required.
Known special unloading requirements will be communicated before shipment whenever reasonably possible.
SECTION 18 — ESTIMATED PRODUCTION AND DELIVERY TIMES
Production, processing, shipping, and delivery timeframes are estimates unless expressly stated as guaranteed in writing.
Estimated timeframes may be affected by material selection, production, customer approval, carrier schedules, customs processing, weather, destination accessibility, force majeure events, or circumstances outside our reasonable control.
Luce Spaces will make reasonable efforts to communicate material delays.
When applicable law requires a customer to be notified of a revised shipping date or provided the choice to accept a delay or cancel for a refund, Luce Spaces will provide the required notice and options.
Except where required by law or expressly agreed in writing, a change to an estimated timeframe does not automatically create a right to cancel products that have already entered production.
SECTION 19 — PARTIAL AND SEPARATE SHIPMENTS
Luce Spaces may fulfill an order through partial or separate shipments when products are available at different times, produced at different locations, or require different carriers or handling.
Separate shipments may have different tracking numbers, carrier arrangements, and delivery dates.
Unless an upgraded service is requested or separately agreed, a customer will not be charged an additional shipping fee solely because Luce Spaces elects to divide an otherwise eligible order into multiple shipments.
If one portion is delivered and another is delayed, the affected portion will be reviewed separately.
A delay affecting only part of an order does not automatically create a right to cancel or receive a refund for products already delivered.
SECTION 20 — CUSTOMER DELIVERY RESPONSIBILITIES
Customers must provide complete and accurate delivery information and respond to reasonable scheduling communications.
If an order has shipped and incorrect or incomplete information causes address correction, rerouting, storage, redelivery, return-to-sender, or other carrier charges, reasonable additional costs may be charged to the customer.
If a customer misses a delivery appointment, cannot be reached, delays delivery, or refuses delivery for a reason unrelated to documented damage, reasonable storage, redelivery, rerouting, return-to-sender, or related carrier charges may be charged to the customer.
Refusing delivery does not automatically cancel an order or create a right to a full refund.
SECTION 21 — LOSS OR DAMAGE IN TRANSIT
Luce Spaces remains responsible for coordinating claims involving products lost or damaged while in transit.
Customers are not required to manage the carrier claim directly, although reasonable cooperation and documentation may be required.
For freight deliveries, the customer should inspect the exterior condition of the crate before accepting and signing for delivery.
If visible damage is present, the customer should:
- Take clear photographs before the crate is moved or opened.
- Write “DAMAGED” clearly on the Bill of Lading or delivery receipt before signing.
- Retain or photograph the signed document.
- Send the order number, photographs, signed document, and a description of the damage to [email protected] as soon as possible.
When damage is concealed and discovered after opening the crate, the customer should notify [email protected] as soon as reasonably possible, preferably within 48 hours and no later than seven calendar days after delivery.
The customer should retain the product, crate, and all original packaging while the claim is reviewed.
Prompt documentation helps preserve carrier claims but does not limit any right that cannot lawfully be waived.
SECTION 22 — IN-TRANSIT SUPPORT
If tracking shows a delay, hold, rerouting issue, missed connection, or another problem before delivery, the customer should contact [email protected].
Luce Spaces will coordinate with the carrier and assist with the appropriate next steps.
SECTION 23 — RETURNS AND REFUNDS
Returns and refunds are governed by our Refund & Return Policy, which is incorporated into these Terms.
Eligible standard, non-custom products may be requested for return within seven calendar days after delivery.
Approved change-of-mind returns are subject to a fifteen percent (15%) restocking fee, customer-paid return shipping, prior written authorization, product-condition requirements, and the original-crate requirement.
The original outbound shipping cost will not be deducted when the qualifying order received free outbound shipping.
Separately purchased expedited or upgraded original shipping services are non-refundable unless otherwise required by law.
Custom-product, sample, and other exceptional return requests are reviewed on a case-by-case basis, and approval or a specific refund amount is not guaranteed.
Unauthorized returns will not be accepted.
SECTION 24 — NO PARTIAL RETURNS
Partial change-of-mind returns are not accepted for quantity-based, lot-based, batch-based, matched-material, or similar purchases.
A return request must cover the entire applicable order line, complete purchased lot, or complete matched batch.
For example, a customer purchasing 1,000 square feet of tile may not return only 200 square feet as a change-of-mind return.
Exceptions may be made only when expressly agreed in writing or where the claim involves verified damage, defect, incorrect quantity, or another error attributable to Luce Spaces.
SECTION 25 — INSTALLED OR MODIFIED PRODUCTS
Products that have been installed, drilled, cut, connected to plumbing, altered, refinished, or otherwise modified are not eligible for change-of-mind returns.
This restriction does not eliminate verified claims involving a defect, transit damage, an incorrect product, or an issue that existed before installation or modification.
SECTION 26 — CARE, SEALING, AND MAINTENANCE
Customers are responsible for following care, cleaning, sealing, and maintenance guidance applicable to the product and stone type.
Natural stone may require periodic sealing depending on the material, finish, installation location, use, and exposure to water, oils, cosmetics, cleaners, or other substances.
There is no universal sealing schedule for every natural stone product.
Luce Spaces is not responsible for damage, staining, etching, discoloration, or deterioration caused by improper care, acidic or abrasive cleaners, bleach, harsh chemicals, unsuitable sealers, standing water, misuse, or failure to follow applicable guidance.
If guidance from an installer, contractor, third-party manufacturer, or another source conflicts with written guidance from Luce Spaces, the customer should request written clarification before proceeding.
SECTION 27 — HANDLING AND INSTALLATION
Professional installation by a qualified and experienced installer is strongly recommended, particularly for heavy natural stone products and products requiring plumbing, wall mounting, structural support, cutting, drilling, or sealing.
Customers and installers are responsible for confirming that the installation location, support structure, plumbing, mounting method, and surrounding materials are suitable.
Luce Spaces is not responsible for damage caused after delivery by the customer, movers, installers, plumbers, contractors, or other third parties during unpacking, moving, drilling, cutting, installation, plumbing connection, or modification.
This section does not apply to verified damage or defects that existed at delivery.
SECTION 28 — NATURAL STONE PRODUCT CLAIMS
Luce Spaces does not promise a fixed-duration commercial warranty for natural stone products unless expressly stated in writing for a specific product or order.
Suspected material or manufacturing defects will be reviewed on a case-by-case basis based on the stone, specifications, installation conditions, care, photographs, and other available evidence.
Natural stone variation is not a defect by itself.
Nothing in this section limits rights that cannot lawfully be excluded.
SECTION 29 — ACCESSORY WARRANTIES
Mounting kits, drains, hardware, and other non-natural-stone accessories may be covered by a warranty provided by their manufacturer.
Any manufacturer warranty is subject to that manufacturer’s terms, exclusions, procedures, and coverage period.
Luce Spaces may provide reasonable assistance with an eligible manufacturer claim but does not promise a separate fixed warranty unless expressly stated in writing.
SECTION 30 — REMEDIES FOR VERIFIED CLAIMS
If Luce Spaces verifies transit damage, a defect, an incorrect product, or a material deviation from approved specifications, Luce Spaces will determine an appropriate resolution based on the circumstances and applicable law.
Possible resolutions may include repair guidance, replacement parts, correction, product replacement, remake, store credit, partial refund, or full refund.
If a replacement, refund, or other resolution is provided, Luce Spaces may require the original product, parts, or accessories to be returned.
When a verified damaged, defective, or incorrectly supplied product must be returned, Luce Spaces will provide or reimburse reasonable return-shipping arrangements.
Customers must retain products and packaging until Luce Spaces confirms whether return, inspection, carrier pickup, or disposal authorization is required.
SECTION 31 — COMMERCIAL USE AND RESALE
Products may be used in residential, commercial, hospitality, design, construction, or other projects.
Customers may resell purchased products subject to applicable law.
Resale or commercial use does not, by itself, create an agency, distributorship, dealership, partnership, endorsement, or official affiliation with Luce Spaces.
SECTION 32 — TRADE, WHOLESALE, AND COMMERCIAL ORDERS
Trade, wholesale, dealer, architect, designer, hospitality, and commercial customers may receive separate pricing, payment terms, minimum order requirements, schedules, shipping arrangements, or other conditions.
Special terms apply only when confirmed through a written quotation, invoice, proposal, or separate agreement.
If special written terms conflict with these Terms, the special terms govern only the applicable order.
SECTION 33 — INTELLECTUAL PROPERTY
The Services, including trademarks, names, logos, text, images, graphics, renders, photographs, drawings, video, audio, product content, and website design, are owned by or licensed to Luce Spaces and are protected by applicable intellectual-property laws.
The Services may be used only for lawful personal or internal business purposes.
No content may be reproduced, distributed, modified, republished, sold, or commercially exploited without prior written permission, except as permitted by applicable law.
Luce Spaces names, logos, designs, and slogans may not be used in a manner that falsely suggests sponsorship, authorization, partnership, or affiliation.
SECTION 34 — THIRD-PARTY SERVICES AND LINKS
The Services may contain links, tools, content, or functionality provided by third parties.
Luce Spaces does not control third-party websites and is not responsible for their content, accuracy, availability, policies, products, or services.
Customers should review applicable third-party terms and privacy policies before using third-party services.
SECTION 35 — RELATIONSHIP WITH SHOPIFY
Shopify provides the ecommerce platform used to offer the Services.
Sales and purchases are made directly between the customer and Luce Spaces LLC.
Shopify is not the seller of Luce Spaces products and is not responsible for order fulfillment, product quality, delivery, returns, or customer claims relating to Luce Spaces products.
SECTION 36 — PRIVACY
Personal information collected through the Services is handled according to our Privacy Policy.
Shopify and other service providers may process information as necessary to operate the Services, process payments, provide fraud prevention, fulfill orders, and support ecommerce functionality.
SECTION 37 — FEEDBACK AND REVIEWS
If a customer submits feedback, suggestions, photographs, reviews, or other content, the customer represents that they have the right to provide it and that it does not violate another person’s rights or applicable law.
The customer grants Luce Spaces a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display the submitted content for operating, improving, and promoting the Services, subject to applicable privacy and consumer-protection laws.
Luce Spaces may remove unlawful, misleading, abusive, infringing, or otherwise inappropriate content.
SECTION 38 — PROHIBITED USES
The Services may not be used:
- for unlawful or fraudulent purposes;
- to infringe intellectual-property, privacy, or other legal rights;
- to transmit malicious code or interfere with website security;
- to submit false or misleading information;
- to impersonate another person or entity;
- to collect personal information unlawfully;
- to interfere with another person’s use of the Services; or
- to circumvent access, security, fraud-prevention, or authorization controls.
Luce Spaces may restrict or terminate access when it reasonably believes these Terms have been violated.
SECTION 39 — PAYMENT DISPUTES AND CHARGEBACKS
Customers are encouraged to contact [email protected] before initiating a chargeback or payment dispute so Luce Spaces has an opportunity to review and resolve the matter directly.
Customers should provide accurate information and reasonably cooperate with requests for order, delivery, damage, return, or refund documentation.
Nothing in this section waives or restricts a lawful chargeback, payment-dispute, or consumer right.
SECTION 40 — DISCLAIMER OF WARRANTIES
Except for warranties expressly stated in writing and rights that cannot lawfully be excluded, the Services and products are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, Luce Spaces disclaims implied warranties including merchantability, fitness for a particular purpose, title, and non-infringement.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, exclusions apply only to the extent legally permitted.
SECTION 41 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, Luce Spaces and its affiliates, officers, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost revenue, loss of use, or replacement costs arising from use of the Services or purchase of products.
Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.
SECTION 42 — INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Luce Spaces and its affiliates, officers, employees, contractors, agents, licensors, and service providers from third-party claims, damages, liabilities, and reasonable expenses arising from:
- your material breach of these Terms;
- your violation of applicable law or another person’s rights; or
- your unlawful or unauthorized use of the Services.
SECTION 43 — TERMINATION
Luce Spaces may suspend or terminate access to the Services when reasonably necessary to address fraud, security concerns, unlawful use, abuse, or a material violation of these Terms.
Termination does not eliminate payment obligations or other rights and responsibilities that arose before termination.
Provisions that by their nature should survive termination will remain effective.
SECTION 44 — SEVERABILITY
If a provision of these Terms is determined to be unlawful, invalid, or unenforceable, it will be enforced to the maximum extent legally permitted, and the remaining provisions will continue in effect.
SECTION 45 — WAIVER AND ENTIRE AGREEMENT
Failure to enforce a provision does not waive the right to enforce it later.
These Terms and the policies and written order-specific documents incorporated into them constitute the agreement between the customer and Luce Spaces regarding the Services and applicable purchase.
SECTION 46 — ASSIGNMENT
Customers may not assign these Terms or their rights and obligations under them without prior written permission.
Luce Spaces may assign its rights or obligations as part of a merger, restructuring, sale, financing, service-provider arrangement, or other lawful business transaction.
SECTION 47 — DISPUTE RESOLUTION
Before starting formal legal proceedings, the customer and Luce Spaces agree to make a good-faith effort to resolve the dispute through written communication.
Customers should contact [email protected] and provide the order number, an explanation of the issue, and available supporting documentation.
If the dispute cannot be resolved informally within a reasonable period, either party may pursue remedies available through a court having proper jurisdiction.
These Terms do not require mandatory arbitration and do not include a class-action waiver.
SECTION 48 — GOVERNING LAW AND JURISDICTION
These Terms and related agreements are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.
Any court proceeding must be brought before a court having proper jurisdiction under applicable law.
Nothing in this section limits mandatory consumer-protection or jurisdictional rights that cannot lawfully be waived.
